Rubbish Removal Shepherds Bush Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Shepherds Bush provides rubbish collection, waste removal and related services to residential and commercial customers. By making a booking, confirming a quotation, or allowing our team to commence work at your premises, you agree to be bound by these Terms and Conditions.
If you do not agree to any part of these Terms and Conditions, you should not use our services. You are advised to read this document carefully before booking.
1. Definitions
In these Terms and Conditions, the following definitions apply:
1.1 "Company", "we", "us", and "our" refer to Rubbish Removal Shepherds Bush, the provider of waste collection and rubbish removal services.
1.2 "Customer", "you" and "your" refer to the person, business or organisation booking our services or on whose behalf the services are booked.
1.3 "Services" refers to any rubbish removal, waste collection, clearance, loading, transportation, disposal or related services provided by the Company.
1.4 "Premises" refers to the property, site or location where the Services are to be carried out.
1.5 "Waste" refers to any items, materials or substances that the Customer wishes us to remove, and that we have agreed are suitable for collection under these Terms and Conditions.
2. Scope of Services
2.1 We provide rubbish removal and waste collection services, which may include household waste, garden waste, office rubbish, bulky items and general non-hazardous waste.
2.2 The specific Services to be provided will be agreed with you in advance based on the description of the waste, the volume or weight, the access at the Premises, and any particular requirements.
2.3 We reserve the right to refuse to collect any Waste that, in our reasonable opinion, is unsafe to handle, not as described, prohibited by law, or falls outside the scope of our licence or insurance cover.
2.4 We do not provide services for the removal of certain hazardous or specialist waste, including but not limited to asbestos, medical waste, chemical waste, pressurised containers, gas bottles, explosives, and any materials that require specialist handling.
3. Booking Process
3.1 You may request a quotation or make a booking by telephone, email or other communication channels made available by us.
3.2 When you make a booking, you agree to provide accurate and complete information about the type, volume and approximate weight of the Waste, the location of the Premises, and any access restrictions or special conditions that may affect the Services.
3.3 Any quotation we provide is based on the information you supply. Quotations may be given as an estimate of the volume, weight, labour and disposal charges and are subject to adjustment if, upon arrival, we find that the Waste differs from the description provided, or that there are additional access issues or delays beyond our control.
3.4 A booking is only confirmed when we have accepted it and provided you with a booking confirmation by telephone, email or text message. We reserve the right to decline any booking request at our discretion.
3.5 You are responsible for ensuring that a person aged 18 or over is present at the Premises at the agreed time to grant access, provide instructions, and approve the work. If no such person is present, we may treat the visit as a cancellation by you and apply the cancellation provisions set out below.
4. Pricing and Quotations
4.1 Our charges are usually based on the volume and type of Waste, the labour involved, and disposal costs. Additional charges may apply for difficult access, extra labour, heavy items, or out-of-hours work.
4.2 Quotations are provided in good faith based on the information you supply. If, on arrival, it becomes apparent that the job is significantly different from what was described, we will discuss revised pricing with you before proceeding.
4.3 Unless otherwise stated, all prices are quoted in pounds sterling and may be inclusive or exclusive of value added tax (VAT), as specified at the time of booking. If VAT is applicable, it will be added to the price at the prevailing rate.
4.4 We reserve the right to adjust our prices at any time. However, the price applicable to your booking will be the price agreed at the time your booking is confirmed, subject to any amendments arising from inaccurate information provided by you.
5. Payments and Invoicing
5.1 Payment for our Services is due immediately upon completion of the work, unless alternative payment terms have been agreed in writing in advance.
5.2 We accept payment by cash, debit card, credit card, and other methods that may be made available. We do not accept payment by cheque unless expressly agreed beforehand.
5.3 For business customers or repeat clients, we may, at our discretion, agree to invoice you with payment due within a specified period. Late payment may result in interest being charged on overdue amounts at the statutory rate allowed under UK law.
5.4 You agree that any dispute about an invoice must be raised in writing within seven days of the invoice date. Failure to do so will be deemed acceptance of the charges.
5.5 Ownership of any Waste passes to us only once it has been loaded onto our vehicle and payment has been made or agreed in accordance with these Terms and Conditions.
6. Cancellations, Amendments and Waiting Time
6.1 You may cancel or amend your booking by contacting us as soon as possible. Because we allocate resources and vehicles to your collection, a cancellation fee may be applied if you cancel at short notice.
6.2 If you cancel more than 24 hours before the agreed arrival time, no cancellation charge will normally apply. If you cancel within 24 hours of the agreed time, we reserve the right to charge a reasonable fee to cover our costs.
6.3 If, upon arrival, we are unable to gain access to the Premises, the Waste is not available, or the job cannot be completed due to circumstances within your control, we may charge a call-out fee or a proportion of the quoted price.
6.4 We allow a reasonable period of free waiting time upon arrival. If our team is kept waiting beyond this period due to delays in access, instructions or other reasons beyond our control, additional charges may apply for waiting time and any extra labour incurred.
6.5 We may cancel or reschedule a booking if we are unable to attend due to reasons such as vehicle breakdown, extreme weather, staff illness, safety concerns, or other circumstances beyond our reasonable control. In such cases, we will inform you as soon as practicable and rearrange the booking at a mutually convenient time. We will not be liable for any indirect losses arising from such cancellation or delay.
7. Customer Obligations
7.1 You are responsible for providing accurate information about the Waste and the Premises, including any potential risks such as sharp objects, broken glass, or hazardous materials.
7.2 You must ensure that the Waste is accessible and, where possible, consolidated in an area that allows safe and efficient loading. If we need to collect items from multiple rooms, floors or areas, or dismantle items, additional charges may be incurred.
7.3 You agree not to include in the Waste any prohibited or hazardous materials. If such materials are discovered, we may refuse to remove them and may charge you for any reasonable costs incurred, including any necessary specialist handling.
7.4 You must ensure that the Premises are safe for our staff to work in, with reasonable access to the Waste and adequate lighting. We may decline to proceed if, in our opinion, conditions are unsafe.
7.5 You are responsible for obtaining any consents, permissions or permits required for us to access and operate at the Premises, including any restrictions on parking, loading or site access.
8. Waste Handling and Environmental Compliance
8.1 We operate in accordance with relevant UK waste regulations, including duty of care requirements and waste carrier obligations.
8.2 We will transport and dispose of Waste at authorised facilities and endeavour to reuse or recycle materials where commercially and practically possible.
8.3 Where required, we may issue a waste transfer note or other documentation in relation to the collection and disposal of your Waste. You agree to provide any information reasonably required for such documentation.
8.4 We do not guarantee that any particular item or proportion of Waste will be recycled or reused, but we will act in a responsible manner and in compliance with applicable legislation and best practice for rubbish collection and disposal.
9. Liability and Limitations
9.1 We will exercise reasonable care and skill in providing our Services. If we fail to do so, we may, at our discretion, rectify the issue, reduce the charge, or provide a refund in full or in part.
9.2 Our liability for any loss or damage arising from our Services is limited to the amount you have paid or agreed to pay for the relevant booking, except in cases where such limitation is not permitted by law.
9.3 We will not be liable for any indirect, consequential or economic loss, including but not limited to loss of profits, loss of business, or loss of opportunity, arising out of or in connection with our Services.
9.4 You must notify us of any alleged damage to property or other issues as soon as reasonably practicable and in any event within 48 hours of completion of the Services. We may need access to the Premises to inspect and investigate any claim.
9.5 We are not liable for damage caused by pre-existing defects, structural weaknesses, poor condition of fixtures or fittings, or hidden hazards at the Premises.
9.6 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot be excluded under UK law.
10. Insurance
10.1 We maintain liability insurance appropriate to the nature of our rubbish removal and waste collection activities.
10.2 Evidence of insurance may be made available to you upon reasonable request, subject to any confidentiality obligations.
11. Complaints and Disputes
11.1 If you are dissatisfied with any aspect of our Services, you should notify us as soon as possible so that we can attempt to resolve the matter promptly.
11.2 Complaints should ideally be made in writing, providing sufficient detail about the booking, the issue encountered, and the outcome you are seeking.
11.3 We will review your complaint and may request further information or photographs. We will aim to respond within a reasonable period and to reach a fair and practical resolution.
11.4 If a dispute cannot be resolved informally, it may be referred to mediation or other forms of alternative dispute resolution, if both parties agree. This does not affect your statutory rights.
12. Privacy and Data Protection
12.1 We collect and process personal data necessary to manage bookings, provide our Services, and comply with legal obligations. This may include your name, contact details, service address and payment information.
12.2 We will handle your data in accordance with applicable UK data protection laws and only retain it for as long as necessary for the purposes for which it was collected, or as required by law.
12.3 We may use your contact details to communicate with you about your booking and our Services. We will not sell your personal data to third parties.
13. Force Majeure
13.1 We will not be in breach of these Terms and Conditions or liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include extreme weather, strikes, road closures, accidents, acts of terrorism, natural disasters or governmental restrictions.
13.2 In such cases, our obligations will be suspended for the duration of the event, and we will use reasonable endeavours to minimise the impact and resume Services as soon as reasonably possible.
14. Changes to Terms and Conditions
14.1 We may amend these Terms and Conditions from time to time to reflect changes in law, industry practices, or the way we operate our rubbish collection services.
14.2 The version in force at the time of your booking will apply to that booking. You are encouraged to review the Terms and Conditions periodically if you are a repeat or regular customer.
15. Severability
15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be deemed severed from the remaining provisions, which will continue in full force and effect.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising from or related to these Terms and Conditions or the provision of our Services, subject to any rights you may have as a consumer to bring proceedings in your local jurisdiction.
By booking rubbish removal or waste collection services with Rubbish Removal Shepherds Bush, you confirm that you have read, understood and agreed to these Terms and Conditions.
